Programme Policies

SMU Executive Development Open Enrolment Programmes

1.All payments shall be made in full to “Singapore Management University” within 30 days of issuance of the invoice, and/or before the commencement of the programme.         
 
2.All payments shall be made in Singapore Dollars, stating tax invoice reference number. Overseas companies remitting the programme fee to SMU will pay an additional administrative and banking charge of S$35 per bank transaction. However if you have instructed your bank to deduct all bank charges incurred to your bank account for the remittance, you can exclude this additional fee.

Singapore Management University reserves the rights, at its sole discretion, to substitute, defer or cancel the open enrolment programme two weeks before the first session. Singapore Management University will not be responsible for registrants’ non-refundable travel related expenses, in which case the participants shall be entitled to, as the case may be, :-

  • accept an offer to attend a substitute open enrolment programme of equivalent fee;
  • reject an offer to attend a substitute open enrolment programme, in which case point 3d shall apply in respect of the refund of the open enrolment paid programme fees;
  • in the event of a deferment of the open enrolment programme, to attend the open enrolment programme at a later date; or
  • in the event of a cancellation of the open enrolment programme, a full refund of open enrolment programme fees already paid to Singapore Management University. For avoidance of doubt, Singapore Management University shall not be liable to refund any transaction cost, such as bank charges and taxes (if any), that the participant may have incurred in the payment of the open enrolment programme fees.
4.

In the event that the participant withdraws from an accepted open enrolment programme, the following Refund Policy on paid programme fees shall apply:-    

31 days written notice or more from the commencement date of the open enrolment programme.

Full refund of open enrolment paid programme fees.

30 days to 15 days written notice or more from the commencement date of the open enrolment programme.

A refund of 75% of the open enrolment paid programme fees.

14 days to 8 days written notice or more from the commencement date of the open enrolment programme.

A refund of 40% of the open enrolment paid programme fees.

7 days written notice or less from the commencement date of the open enrolment programme.

No refund of open enrolment programme paid fees.

4.1.In the event that the participant defers attendance for open enrolment programme, the following Deferment Policy shall apply:- All deferment requests from a programme must be received 14 days or more before the start date. If a deferment request is submitted less than 14 days before the start date of the programme, an amount of SGD327 (inclusive of 9% GST) will be charged. Participant may only defer from the programme/module a maximum of 2 times and within the maximum tenure allowed for the programme. After 2 times it cannot be deferred any further and full cancellation charges apply.         
 
5.Singapore Management University may, at its sole discretion, make changes to the time, venue and trainers of the open enrolment programme.         
 
6.In the event of a force majeure event, or any event that is beyond the control of Singapore Management University, Singapore Management University shall be excused from complying with any of its obligations and from any liability for Non-performance of those obligations for the duration of the event provided that Singapore Management University is not at fault in causing that event.         
 
7.The participants shall cooperate with the representatives of Singapore Management University and execute such documents and take such actions as may be reasonably be requested from time to time.         
 
8.All intellectual property rights to any materials used at the open enrolment programmes shall belong to either Singapore Management University or the respective trainers unless agreed otherwise.         
 
9.In any presentations made by the participants in the open enrolment programme, the participants represent and warrant that they will not infringement any third party intellectual property rights and agree to indemnify Singapore Management University against any such third party claims for breach of any third party intellectual property rights.         
 
10.Singapore Management University shall not be liable for any indirect, special or consequential losses arising out of or in connection with the open enrolments programmes or any breach of non-performance of it no matter how fundamental and whether or not Singapore Management University has been informed or made aware of such possible losses or its reasonably foreseeable.         
 
11.Singapore Management University’s total liability to any one participant for whatever cause of action, shall be limited to the fees paid by that participant.         
 
12.This Terms and Conditions shall be governed by and construed in accordance with the laws of Singapore.          
 
13.The parties agree that any disputes and disagreements shall be submitted to mediation to the Singapore Mediation Centre, in accordance to the Singapore Mediation Centre rules.         
 
14.Personal Data Protection         
Singapore Management University (SMU) respects the privacy of individuals and recognizes the importance of the personal data you have entrusted to us and believe that it is our responsibility to properly manage, protect, process and disclose your personal data. We will collect, use and disclose your personal data in accordance with the Personal Data Protection Act 2012. General Data Protection Regulation (GDPR)         
The General Data Protection Regulation (GDPR) is a new EU framework for data protection that will apply from 25 May 2018.         
The framework applies to all businesses processing and holding the personal information of data subjects residing in the European Union, regardless of where the business is located. SMU is working to align our privacy framework and business practices with the GDPR, which offers a range of new and enhanced rights for individuals. A University-wide improvement programme is currently underway to further strengthen the way in which we protect personal information. In view of GDPR, individual located in EU need to complete and submit to us the online form upon registration.

Singapore Management University (SMU) and its various schools, offices, institutes and centres (“Units”) may collect, use and disclose your personal data that you provide in this Form for the purpose of sending you updates about the programme. You also consent to the disclosure of your personal data to SMU partners/affiliates and other third party service providers that SMU may engage from time to time.      
 
If you are providing someone else’s personal data or submitting this Form on behalf of someone else, you hereby declare that you have obtained consent from the named individual(s) in this Form, for the collection, use and disclosure of his/her personal data by you to SMU, SMU business partners and other third party service providers.      

Please note that photography and videography may be carried out during the programme by SMU and the Units. SMU and the Units may use some or all of these images in its print publications, digital, social media platforms and/or marketing channels.      
 
If you do not wish to appear in the photographs or for your photographs to be used, kindly inform us in writing prior to the event at exd@smu.edu.sg.     
 

 
16.SMU required minimum attendance rate of 90% from participant in all our programmes in order to receive our Executive Certificate of Completion.

Virtual Programme’s Terms and Conditions

Participant Notices

The purchase of webinar attendance is for use by the purchaser only and registration information should not be forwarded on to third parties; doing so may hinder your own access, as webinar entry is by prior registration only. Similarly, the materials and replay of webinars are for use by the purchaser only and should not be forwarded on to third parties. Responsibility for the confidentiality and security of webinar registration information and event materials issued by SMU, EXD (“SMU, ExD”) lies with the registrant. If you believe that a third party has obtained details in an unauthorised manner, please promptly notify SMU Executive Development.

A purchaser for the purposes of these Webinar Terms and Conditions means every natural person who enters into a legal transaction for purposes that predominantly are outside his trade, business or profession. Participants who take part in seminars via their employer are not purchasers since in this case (for example if the employer books the seminar for their employees) it is not they themselves but rather their employer who is the contractual partner with SMU, ExD.

Webinars and Virtuals are recorded

The virtual event facility includes a feature that allows audio, any documents or other materials viewed during the session to be recorded. By joining a session, you automatically consent to such recordings. If you do not consent to the recording, please contact SMU Executive Development to discuss your concerns in good time prior to the web-event date.

Web-event participation may require you to configure your software settings on your web-device upon first use, or require you to download the software for your operating system. Software can be manually downloaded by visiting the Download Center. Please note that you may require administrator privileges on your computer to be able to manually install software.

Learning Outcomes

SMU EXD will not be liable for any loss or damage: 

  1. that the Partner/Participant may incur on account of using, visiting or relying on any statement, opinion, representation or information in the Virtual session;
  2. resulting from any delay in the operation or transmission, communications failure, Internet access difficulties or malfunctions in equipment or software; or
  3. the availability or content of any other Internet site (not provided by SMU, ExD). Access to any other site is at your own risk.

The opinions expressed in a Webinar are those of the author (s) only, and may not necessarily represent the views of SMU or of any other SMU Institution. To the extent permitted by law, SMU and its agents and experts exclude any and all liability for any loss, claim or damage, cost or expense, including any indirect or consequential damages or lost profit, whether arising in negligence or otherwise, suffered in connection with the access to, participation in, or use of the Webinar by you or any other person.

Privacy Policy

In connection with the operation of the webinar we will ask you to provide us with information that personally identifies you or allows us to contact you ("Personal Information") when you register for the use of the service. The Personal Information that you provide us in these circumstances will be provided to SMU, EXD's provider of its audio- and web-conferencing services, and vendors that assist them in processing the information, for the sole purpose of enabling them to operate and deliver the webinar service. It is a requirement of SMU, EXD's partner vendors to enter into an agreement prohibiting disclosure of this information to others and restricting its use to providing the contracted services of the webinar. The only exception to this is necessary disclosure for legal purposes in line edicts of the law.         

SMU, EXD's provider of its audio- and web-conferencing services for webinars is a market-leader of audio- and web-conferencing services. With this comes the understanding of users' need for privacy when using the web for communications and the utmost care in providing the highest levels of security possible. The Personal Information that SMU, EXD's provider of its audio- and web-conferencing services collect from webinar registrants is stored in operating environments that employ reasonable security measures and that are not available to the general public. SMU, EXD and SMU, EXD's provider of its audio- and web-conferencing services are not responsible for unauthorised access to such information by hackers or others that obtain access through illegal measures.

A copy of SMU, EXD's audio- and web-conferencing service provider's practices and policy with respect to the collection, use and disclosure of user information collected through use of their technology services can be obtained by contacting SMU, EXD. Please refer to SMU, EXD's Privacy Statement with respect to SMU, EXD's use of personal information.

Copyright

The content of all events and all materials (webinar documents, recordings that are made available, etc.) are the intellectual property of SMU, ExD Webinars or the respective instructor and are protected by copyright. They may be used exclusively by the registered Participant to whom they were made available. In particular, publication even if only in part, reproduction, distribution and editing are prohibited as is the recording of an event in audio or video or by means of screenshots. Legal proceedings may be initiated in the event of any misuse.

The Participant agrees to respect copyright and only use the live webinars / video courses individually for their own use under the terms of the contractual agreement.

Rules for Online/LIVE Virtual Conduct

You agree to use the sites in accordance with all applicable laws. You further agree that you will not email or post any of the following content anywhere during the discussion, or on any other SMU, ExD computing resources:

  • Content that defames or threatens others
  • Harassing statements or content that violates federal or state law
  • Content that discusses illegal activities with the intent to commit them
  • Content that infringes another's intellectual property, including, but not limited to, copyrights, trademarks or trade secrets
  • Material that contains obscene (i.e. pornographic) language or images
  • Advertising or any form of commercial solicitation
  • Content that is otherwise unlawful
